CA Tax Incentive Program Now Includes Some Unscripted ProductionGood news for unscripted production in SoCal – CA state bill AB1138 that opens the door for tax credits for unscripted production has passed!
Here's the relevant language for what's now included in the increased tax credit percentage in CA: For taxable years beginning on or after January 1, 2025, and only for purposes of the credit allowed in subdivision (k), a large-scale competition show, not including traditional reality, game shows, talk shows, or docufollow television programming, that is produced in California, with a minimum production budget of one million dollars ($1,000,000) per episode. You can read the specific text of the final bill here. This bill is in addition to the other recent bill increasing the CA state cap on the tax credit program from $330 million to $750 million. Write Your California State Senator and Assembly Member to Request a Carve-Out of AB5 for EntertainmentLet's make our representatives aware that AB5, by forcing all employers – no matter where they're located – to hire California-based workers as employees rather than independent contractors, is effectively shutting down employment in entertainment for Californians. The fringe rate in CA is unusually high (typically around 18%), so productions don't want to come to CA, even with tax credits available, and they don't want to hire CA-based people for productions happening outside California.
